Commercial API Terms

Last updated 2026-09-08.

These terms govern the DoINeedVisa API at api.doineedvisa.to and the MCP server at mcp.doineedvisa.to (and the app-route mirror). Agent- or LLM-mediated access through the MCP server, or through any other automated client, is “the API” for purposes of these terms. They are a separate, stricter document from the consumer Terms of Service: using the data to power a business carries a different liability profile from a traveller reading a web page. By requesting or using an API key, or calling the API, you agree to these terms on behalf of yourself and any organization you represent.

1. What the API provides

The API serves structured visa-requirement facts for passport/destination country pairs - requirement type, permitted stay, official links, and the date each row was last verified - assembled from a community-maintained open dataset (see Section 7). It is general informational data, not advice, and not an official government feed.

2. License to use the API and data

Subject to these terms and your tier’s limits, DoINeedVisa grants you a non-exclusive, non-transferable, revocable license to call the API and to use and display the returned data within your product or service. Redistribution and resale are permitted only where the upstream MIT license allows it and only if you carry the attribution notice in Section 7 with any substantial portion of the data. You may not remove or obscure that attribution.

3. Not for compliance, boarding, or eligibility determinations

The data must not be used as the basis for compliance, boarding, admission, or visa-eligibility determinations, or for any decision that affects a person’s ability to travel, board a carrier, enter a country, or obtain a visa or permit. Visa requirements change frequently, vary by individual circumstance, and are set solely by destination governments. Any such determination must be made against official government sources. You are responsible for your own use of the data and for any decision you or your systems make from it.

By using the API, you acknowledge that visa, transit, entry, and travel rules can change without notice and that API data may be incomplete, delayed, or incorrect. You agree not to rely on the API as your sole source for any travel, compliance, boarding, admission, or eligibility decision. You must independently verify the current rules with the relevant government and any carrier or other authority responsible for the decision.

4. No warranty

The API and its data are provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, completeness, timeliness, non-infringement, merchantability, or fitness for a particular purpose. DoINeedVisa does not warrant that the data is correct or current, that the API will be uninterrupted or error-free, or that any defect will be corrected.

5. Limitation of liability

To the maximum extent permitted by law, DoINeedVisa and its operator are not liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to your use of (or inability to use) the API or reliance on its data - including denied entry, denied boarding, missed or cancelled travel, deportation, fines, or visa-application costs incurred by you or by any end user of your product. This applies regardless of the theory of liability and even if DoINeedVisa was advised of the possibility of such damages.

Nothing in these API Terms excludes, restricts, or modifies any consumer guarantee, right, remedy, warranty, or other term implied or imposed by the Australian Consumer Law or another applicable law that cannot lawfully be excluded, restricted, or modified. Where applicable law permits liability for failure to comply with a non-excludable guarantee to be limited, our liability is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.

Subject to those non-excludable rights, our aggregate liability for claims arising from paid API access that cannot be excluded but may lawfully be limited is limited to the greater of the amount you paid DoINeedVisa for API access in the three months preceding the claim or AUD 50. For anonymous or other free access, that aggregate limit is AUD 50.

You indemnify DoINeedVisa against a third-party claim only to the extent that it arises from your unlawful use of the API, your material breach of these terms, or your negligent or wilful act or omission when integrating or using the API. This indemnity does not apply to the extent that a claim is caused by DoINeedVisa’s breach, negligence, or unlawful conduct, or to the extent the indemnity is prohibited by law.

6. Acceptable use

  • Keep your API key secret. It is your sole credential; you are responsible for all calls made with it. Report a suspected leak so it can be rotated.
  • Stay within your tier’s rate limits and quota. Don’t share keys across unrelated products, circumvent metering, or run multiple free keys to evade limits.
  • Don’t attempt to evade the anonymous free-access limit (for example by rotating source addresses) or automate bulk collection through it in place of a keyed tier meant for that volume.
  • Don’t use the API to build or train a competing bulk visa-data product, or to scrape the full matrix for wholesale redistribution outside the Section 2 license.
  • Don’t use the API for unlawful purposes or in a way that degrades the service for others.

7. Data source & attribution (MIT)

Visa-requirement data is sourced from passport-index-data, which is MIT-licensed. MIT permits commercial use and redistribution but requires that the copyright and permission notice travel with all copies or substantial portions of the data. The API serves a substantial portion, and every data response carries a short-form attribution in the source field and the X-Data-Source header. We also regularly check official government websites to verify and update this data; it is not purely a community-maintained feed. If you redistribute or expose this data, you must reproduce the notice below.

8. Tiers, fees & payment

Free-tier access is provided at no charge within its published quota. Paid tiers (agency, enterprise), when purchased, are billed per the plan you select; quotas and limits are enforced per key. Fees are non-refundable except where required by law. DoINeedVisa may change tier pricing or limits on reasonable notice; a change does not affect a billing period already paid for.

The MCP server additionally offers ongoing no-signup anonymous free access with a small daily call cap published in the MCP docs. It is not an account and carries no support or SLA commitment. Limits may change on reasonable notice, or immediately where needed to protect the service from abuse or a security threat.

9. Suspension & termination

DoINeedVisa may suspend or revoke a key, or terminate access, for breach of these terms (including any Section 3 or 6 breach), for non-payment, or where required to protect the service or other users. You may stop using the API at any time. Sections 3–7 and 10 survive termination.

10. Changes to these terms

These terms may be updated from time to time; the “last updated” date above will change accordingly. Material changes affecting paid tiers will be communicated to the account contact. Continued use of the API after an update means you accept the revised terms.

11. Governing law

These API Terms are governed by the laws applicable in Australia. Each party submits to the non-exclusive jurisdiction of courts of competent jurisdiction in Australia and the courts that hear appeals from them. This section does not limit any right a party may have to bring a claim in another forum under an applicable consumer protection law.

12. General

Force majeure. To the extent permitted by law, DoINeedVisa is not liable for a failure or delay caused by an event beyond its reasonable control, including a government-system or source-data outage, an abrupt government-policy change, a hosting or internet outage, a cyberattack, a natural disaster, industrial action, or government action. DoINeedVisa will use reasonable efforts to restore the affected service. This paragraph does not affect a right or obligation that cannot lawfully be excluded.

Entire agreement. These API Terms, any documents they expressly incorporate, and any applicable order form constitute the entire agreement between you and DoINeedVisa concerning the API and supersede prior discussions or representations about the API. Nothing in this paragraph excludes liability for fraud or misleading or deceptive conduct, or limits a right that cannot lawfully be excluded.

Severability. If any provision of these API Terms is held to be invalid, illegal, or unenforceable, it is ineffective only to the extent of that invalidity, illegality, or unenforceability. The remaining provisions continue in effect.
